See Exhibit B: Very shortly before the start of the 2009 legislative session Washoe County
Clerk Amy Harvey contacted George and Margaret Flint inviting them to her office for a meeting
to discuss the concept of creating a program that would allow for Marriage Licenses to be issued
through a commercial wedding chapel. Also present at the meeting were Karen Erickson, Nancy
Parent and a gentleman from Mrs. Harvey's technical department, a gentleman named Randy?
It was the opinion of all involved that the concept was workable and Mrs. Harvey encouraged
the Flints to ask then Chairman of Assembly Judiciary Bernie Anderson for a Bill Draft Request.
Before the introduction of the bill Mrs. Harvey had a change of heart and asked that the bill not
go forward. However not only was AB262 introduced but it successfully passed the first house
with a very minor amendment which made the program permissible rather than a mandate on
the part of the county clerk. The bill hit a roadblock in the upper house, and with Mrs. Harvey's
assurance, that she had found a way, within her budget, to maintain the mandated hours of
operation for the marriage license bureau per NRSl22.040 the section of the bill authorizing the
implementation of marriage licensing agents was amended from the bill. The amended bill
passed the Senate unanimously.
See Exhibit C: In the Special Session of February 2010 the reverse happened and the county
was authorized to deviate marriage license bureau hours of operation per AB22 of that Special
Session.
The wedding industry is unique compared to other industries as it is completely dependent on
the availability of the County Clerk's Office for their ability to do business. I cannot think of one
other industry that is completely out of business when a governmental office is closed.
Car Dealerships aren't out of business when DMV is closed and in fact work very closely with
DMV sharing responsibilities such as assisting clients with their vehicle registrations. These
registrations can also be done online along with registration renewals
&
driver's license
renewals. Lobbyists for car dealerships and motor transport associations confirm that DMV
would like to pass even more responsibility on to car dealerships such as the issuance of license
plates. However it is the car dealerships that are resisting right now not DMV.

one problem in 30 years.
Hawaii licensing agents issue marriage licenses at floral shops, photography studios and even
convenience stores with no problems.
The Humboldt County Clerk, Tami Rae Spero, in Winnemucca, Nevada has been working with a
local flower shop/wedding chapel allowing the proprietor to issue marriage licenses since 1993.
Ms. Spero indicated to George Flint very recently that there has never been a single problem
with that privatization. This bill will bring Winnemucca into compliance.

See Exhibit F: The Department of Wildlife requires personal information to obtain fishing or
hunting licenses. That personal information includes social security numbers. Fishing and
Hunting Licenses can be obtained at Wal Mart, Raley's, Long's Drugs, CVSPharmacy's and many
Sporting Goods and Convenience Stores.
The bill will have no effect upon Clark County or any effect there.
Only counties with wedding chapels having been established for no less than five years will be
eligible to participate in the program. There are only five independently owned wedding chapels
in Washoe County that will qualify for the program .. This bill will bring Winnemucca into
compliance.

this proposal again with Washoe County Clerk Amy Harvey. Margaret Flint and Kathy Marino did
meet with Mrs. Harvey, Karen Erickson and Nancy Parent on January
zo",
2011, just prior to this
legislative session. We also requested a meeting with her just after the introduction of S838l.
Senator Manendo also requested to participate in the meeting. Mrs. Harvey respectfully
declined.
The fiscal savings to the counties could be huge. Washoe County Commissioner Kitty Jung in a
meeting with Margaret Flint and Kathy Marino announced more cuts were on the way. The
wedding industry has been unable to acquire confirmation as to future proposed cuts.
So why should you support this bill?
It saves the county money and puts no one out of business. It caters to tourism and badly
needed tourist dollars. These dollars trickle down into our community and back into the pockets
of workers in both public and private sectors. And let us not forget that these Nevada style
wedding/marriage licenses are what funds our domestic violence programs. This bill is a viable
and simple solution to a problem that shouldn't be clouded with red tape and opposition.

A belated Happy New Year to you!! I hope this letter finds you well and hopeful for a
prosperous 2009.
By now you have all received our year-end report with figures for marriage licenses
issued in 2008. Just when you thought things couldn't get worse, they do. The challenges being
facedby business owners, especially those in a tourist-oriented market, are huge.
As we all know, government is also facing a financial crisis and every possible avenue to
reduce costs is being explored. Along those lines, the statutory hours of operation of the Clerk's
Office is one area being monitored for possible costs savings. Another item being discussed is
the possible relocation of the Marriage License Bureau to the front of the Courthouse (accessed
by using the ramp entrance on Court Street) to reduce heating/cooling costs and eliminate the
need for and cost of security screening.
To the extent that you have thoughts on these issues, or any statistical data relating to
your operations and which days or hours are noticeably slower for your business, those would be
taken into consideration in the analysis of our operation. Any information you have along those
lines, if conveyed to me, can in turn be relayed to the Board of County Commissioners during
our upcoming budget discussions and hearings.
We are also closely monitoring legislation in Carson City and wanted to let you know of
several Bills and Bill Draft Requests (BDR's) that may affect your business. A brieflist of the
pending legislation and its description is enclosed for your use and reference should you desire to
track the legislation in progress.
There has never been a better time for the chapel industry to band together to promote
itself and work to end a 20-year continual decline in the wedding business. I invite you to the
discussion process for the marriage license operations at the County and State levels. It is my
hope that solutions can be found to benefit all parties involved in the process, from our tourists to
our businesses, to our local citizens who rely on government to be efficient and accountable and .
to provide accurate, dependable information and documentation at all times.

The Washoe County Clerk is opposed to the idea of chapels issuing marriage
licenses. As the Flints indicated, Ms. Harvey did entertain discussions with them
when we were first told we had to cut $500,000 from our County budget. We were
concerned about having to keep the marriage license open until midnight, 365 days
a year. We did that against our better judgment, under a lot of pressure and before
talking to our fellow county clerks. We have since found a way to maintain the
office hours mandated by the statutes. Therefore, we are opposed to the chapels
issuing marriage licenses.

SB381 was introduced and referred to the Senate Committee on Judiciary last evening March
21st, 2011. This bill would allow for licensing agents affiliated with the commercial wedding
chapels during times a marriage license is not available through your office due to budget cuts
and deviation of hours.
It is my sincere hope that we can come together and reach a consensus that will not only
allow for the survival of wedding related businesses but also contribute to our damaged
and declining tourist industry in northern Nevada.
I would welcome an additional opportunity for all interested parties to meet and once again
address the concept and how we can "all" make it work prior to a Committee hearing. This
pioneering effort could be a fabulous adventure historically for each of us as we find a way to
work together for the greater good.
Please let me know if you have an appetite to put our heads together.

As you know from prior legislative efforts, the County Clerks in Nevada have no appetite for allowing
marriage license agents to issue marriage licenses. Given that, while I appreciate Senator Manendo's
willingness to meet on the issue, I must respectfully decline. I cannot in good conscience participate in
negotiations of such a proposal when I don't believe it to be in the best interests of the State of Nevada and
knowing full well that my counterparts throughout the State are opposed to it.

spoke with Senator Manendo this afternoon. He expressed to me his willingness and desire
to participate and even host a meeting with us.

your day time hours aren't flexible for you
he is happy to meet in the evening. He would very much appreciate all of us getting together
with him prior to the formal hearing which at this point has yet to be scheduled.
